Acceptable Use Policy

This Acceptable Use Policy ("AUP") forms part of, and is incorporated by reference into, the Terms of Service between EZProvider Networks, Inc. ("EZProvider," "we," or "us") and you ("Customer," "you," or "your"). By accessing the Site or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by this AUP.

Section 1 Prohibited Uses of the Services

(a) Illegal Activities: Any activity that violates Canadian law or the laws of any jurisdiction where the Services are accessed or used, including but not limited to:
- Distribution of child sexual abuse material or any illegal content
- Sale or distribution of controlled substances without proper licensing
- Fraud, phishing, or financial scams
- Unauthorized access to computer systems or networks

(b) Intellectual Property Infringement:
- Infringing any copyright, trademark, patent, or other intellectual property rights
- Hosting pirated software, warez, or unauthorized copyrighted material

(c) Spam and Unsolicited Communications:
- Sending unsolicited bulk email ("spam") or commercial electronic messages
- Operating email lists obtained through illegal or deceptive means
- CASL Compliance: All commercial electronic messages sent using the Services must comply with Canada's Anti-Spam Legislation (CASL), including obtaining express or implied consent, providing proper identification, and including unsubscribe mechanisms
- Compliance with recipient jurisdiction laws (e.g., CAN-SPAM Act for US recipients, GDPR for EU recipients)

(d) Security Violations:
- Unauthorized access to any computer system or network
- Distribution of viruses, malware, ransomware, or other malicious code
- Denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
- Port scanning, vulnerability scanning, or penetration testing without authorization

(e) Resource Abuse:
- Excessive resource consumption that degrades service for other customers
- Use of Services as offsite backup storage or file dumping
- Cryptocurrency mining or other high-compute activities
- Running IRC servers, proxy servers, or similar high-resource applications on shared hosting

(f) Prohibited Content and Activities (in addition to Section 7 of the Terms):
- Hate speech, harassment, or threats
- Promotion of violence or illegal activities
- High-yield investment programs (HYIP), Ponzi schemes, or MLM schemes
- Payday loan sites or gambling sites without proper licensing

(g) AI/ML Abuse:
- Training large language models or machine learning systems without authorization
- Using Services for unauthorized AI inference or data scraping

Legal Adult Content: Legal adult content is permitted on all hosting plans, provided it complies with all applicable laws and does not violate any other provision of this AUP or the Terms.

Section 2 Email Service Requirements

(a) You are responsible for ensuring all email sent using the Services complies with CASL and all applicable laws.

(b) You must maintain proof of consent for all commercial email recipients and provide it to EZProvider upon request within 72 hours.

(c) Email accounts must be used consistent with typical business usage. EZProvider reserves the right to suspend email services that appear to be used for abuse, spam, or excessive storage unrelated to legitimate email communication.

Section 3 Copyright and Intellectual Property Complaints

(a) EZProvider complies with Canada's "Notice and Notice" regime under the Copyright Modernization Act. Upon receipt of a properly formatted notice of alleged copyright infringement, EZProvider will forward the notice to the Customer and retain records as required by law.

(b) EZProvider reserves the right, in its sole discretion, to remove or disable access to content that appears to infringe intellectual property rights upon receipt of credible notices or court orders.

(c) Customers may contact abuse@ezp.net regarding copyright complaints or counter-notifications.

Section 4 Enforcement and Remedies

(a) EZProvider reserves the right to monitor network traffic and investigate suspected violations of this AUP.

(b) Violations of this AUP constitute material breaches of the Terms and may result in:
- Warnings and opportunity to cure (minor violations)
- Immediate suspension of Services (moderate violations)
- Immediate termination without notice (severe violations)
- Administrative fees for abuse remediation (e.g., IP delisting)

(c) Termination pursuant to this AUP is governed by Section 9 (Suspension and Termination) of the Terms.

Section 5 Service-Specific Guidelines

(a) Shared Hosting: Subject to CloudLinux LVE limits and fair usage policies designed to prevent resource abuse.

(b) VPS and Dedicated Servers: Customers have greater control but remain subject to all other AUP provisions.

Section 6 Limitation of Liability

Nothing in this AUP modifies the warranties, limitations of liability, or indemnity obligations set forth in Sections 13, 14, and 15 of the Terms.

Section 7 Governing Law

This AUP shall be governed by and construed in accordance with the laws of British Columbia, Canada, pursuant to Section 19(a) of the Terms.

Section 8 Severability

If any provision of this AUP is found to be illegal, invalid, or unenforceable, the remainder shall remain in full force and effect, pursuant to Section 19(b) of the Terms.
